OUR LEGAL FEES AND DISBURSEMENTS

Debt Recovery stage 2 – Court proceedings

If the debtor fails to respond to letter before action or fails to pay within 14 days, court proceedings may be commenced. This involves lodging a Claim Form/Particulars of Claim with the relevant court.

The court will effect service of Claim Form/Particulars of Claim on the defendant who will have 14 days within which to acknowledge service and if the defendant does so the defendant will be entitled to a further 14 days within which to file any defence to be relied upon. If proceedings become defended, it will be necessary for us to discuss and agree a new fee/disbursement estimate as the details provided here relate to undisputed debt claims.

If the defendant fails to acknowledge service and/or fails to lodge any defence, you will be entitled to apply to the court for summary/default judgment. You will be entitled to recover court fee paid and fixed costs in addition to the sum claimed.

Our fees for issuing proceedings are as follows:

  • Agreed on a case by case basis.

Disbursements

A court fee is payable upon the institution of proceedings.The court charges a fee which is on a sliding scale depending on the amount of the debt claimed.
